Obtaining a report/record from ambulance, fire, police

 

Records Requested Pursuant to Colorado Open Records Act (CORA) and the Colorado Criminal Justice Records Act (CCJRA)

Because Longmont Public Safety is a criminal justice agency, most of its records will be criminal justice records, and therefore records requests will generally fall under the provisions of the CCJRA.  Criminal justice records for a specific case are not subject to release until after the investigation has been closed, and it has been determined that release will not jeopardize any ongoing case.

The recommended response times in CORA are not applicable to records covered by the CCJRA.  Further, under CCJRA, with the exception of records of “official action,” as defined by statute, the disclosure of other criminal justice records is at the discretion of the custodian, and may be denied where the custodian believes disclosure would be contrary to the public interest.

All other records maintained by Longmont Public Safety can be obtained in two ways:

1. By mail. There is a fee for the release of any criminal justice record. Cash, check, and credit cards can be accepted as forms of payment. All credit card transactions require a 2.95% fee in addition to the cost of the report.

Print out the form (pdf) in English/Spanish. Complete the form and mail to: Longmont Department of Public Safety, Records Unit, 225 Kimbark St., Longmont, CO  80501. Do not complete and mail the form WITHOUT contacting records first. Please specify on the form if you would like the report sent to you by postal mail or email.

2. In person. A form will be provided at the Longmont Department of Public Safety Records Unit window (1st floor, Safety and Justice Building, 225 Kimbark St., Longmont, Colorado). They will provide a cost for the document you are requesting.

The records custodian will review your request to determine if the record(s) are releasable pursuant to CCJRA or CORA.

Office Procedure for Handling Records Requests

The length of time needed to respond to requests for criminal justice records governed by Colorado Criminal Justice Records Act (CCJRA) will often take longer and will depend upon the nature of the request.  Longmont Public Safety receives a large number of criminal justice records requests each year.  Many of these requests require time-consuming review and most require redactions.  For these reasons, and depending upon the amount of records requested, criminal justice records requests may take weeks and even months to process.

The requesting party will be notified if the requested records are not available, if the records are not covered by CORA, or they will not be released under CCJRA. A request received after noon or any day the Office is officially closed will be considered received as of the following working day.  For CORA requests, the Office may add up to a seven‐working‐day extension if extenuating circumstances apply as described in section 24‐72‐203(3)(b), C.R.S..  The Office will provide all findings of extenuating circumstances to the requestor in writing. Broad, general requests will likely be more costly to the requestor because of the staff time required to fulfill these requests.  The Office may contact the requestor in an attempt to clarify or narrow a request.  Longmont Public Safety is not required to create reports or compilations of computerized data or to modify existing records in order to create a new record in response to a records request.

Ambulance

 

The City of Longmont partners with American Medical Response (AMR) for ambulance services. The release of any medical information (including billing) requires a signed Health Insurance Portability and Accountability Act (HIPAA) release.

Fire

Longmont Fire Services is an all hazard response division. The department responds to all fire, medical, hazardous materials, and rescue situations.  Office hours are Monday - Friday 7 am to 6 pm.

Police

 

The Longmont Police Records Section is open 5 days a week (Monday - Friday, 7 am to 6 pm). The Longmont Police Services Records has reports ONLY for incidents that have occurred within the Longmont city limits. Some reports may not be immediately available due to pending investigations or based on the Colorado Open Records law.

You can obtain a copy of an INCIDENT report in three ways:

1. By mail. Please call (303) 651-8502 to confirm that your report is available and releasable. There is a fee for the release of any criminal justice record. Cash, check, and credit cards can be accepted as forms of payment. All credit card transactions require a 2.95% fee in addition to cost of the report.

Print out the form (pdf) in English/Spanish. Complete the form and mail to: Longmont Department of Public Safety, Records Unit, 225 Kimbark St., Longmont, CO 80501. Do not complete and mail the form WITHOUT contacting records first. Please specify on the form if you would like the report sent to you by postal mail or email.

2. In person. Staff will check for the availability of your report and a form will be provided at the Longmont Department of Public Safety Records Unit window (1st floor, Safety and Justice Building, 225 Kimbark St., Longmont, Colorado). They will provide a cost for the document you are requesting.

3. Accident Report Only. If you are seeking a copy of an accident report within the Longmont city limits, Longmont Public Safety offers an option to utilize CARFAX in lieu of utilizing our records department to obtain your accident report. The current CARFAX fee is a flat fee (approximately $5.25). You can access CARFAX at this link.

You can obtain DIGITAL MEDIA (photos, dispatch tapes, video, body cam footage, etc.) in two ways:

1. By Mail. Please email or call (303)774-4555 to confirm that your digital media is available and releasable. There is a fee for the release of any criminal justice digital media. Cash, check, and credit cards can be accepted as forms of payment. All credit card transactions require a 2.95% fee in addition to cost of the report.

Print out the digital media form in English/Spanish (pdf). Complete the form and mail it to Longmont Department Public Safety Records Unit: ATTN: Digital Media Evidence Technician, 225 Kimbark Street, Longmont, CO 80501. Do not compete and mail the form without contacting the Digital Media Evidence Technician first. Please specify on the form how you would like to receive the digital media.

2. In person. Staff will check for the availability of your request and a form will be provided at the Records Unit window (1st floor, Safety and Justice Building, 225 Kimbark Street, Longmont, CO  80501). You will be provided a cost for your request.
